California law gives tenants the right to request a pre-move-out inspection. During this inspection, you must identify any issues that could result in deposit deductions, giving the tenant a chance to fix them before moving out.

Required timing: This notice must be provided when the tenant gives notice to vacate or when you give notice to terminate tenancy.

This form satisfies California’s legal requirement to inform tenants of their inspection rights. Keep a copy for your records showing compliance with state law.

California Civil Code Section 1950.5(f) gives you the right to request an initial inspection of the rental property before you move out. This inspection will allow you to be present to see any problems that may result in deductions from your security deposit.

If you want to request this inspection, you must do so in writing. We will then schedule the inspection on a mutually agreed date, no earlier than two weeks before you move out.

During this inspection, we will provide you with an itemized statement of proposed deductions from your security deposit. You will then have an opportunity to remedy the identified issues before your final move-out date.

What is a Pre-Move-Out Inspection?

California Civil Code ยง1950.5(f), effective January 1, 2003, requires landlords to notify tenants of their right to request an initial inspection before they move out. This law was designed to reduce security deposit disputes by giving tenants a chance to fix problems before the final inspection.

When Must You Provide This Notice?

You must provide this notice:

  • When the tenant gives notice they’re moving out, OR
  • When you give the tenant notice to vacate

The notice should be provided along with or soon after the move-out notice is given.

What Happens During the Inspection?

If the tenant requests an inspection:

  • Schedule mutually agreed time – Must be no earlier than 2 weeks before move-out
  • Tenant has right to be present – They don’t have to attend, but must be given the opportunity
  • Provide written itemization – List specific deficiencies that could result in deductions
  • Allow time to remedy – Tenant gets opportunity to fix issues before final move-out

What Can Tenants Fix?

Tenants can typically remedy:

  • Cleaning (kitchen, bathroom, carpets, etc.)
  • Minor repairs (small holes, loose fixtures)
  • Removing personal items or trash
  • Landscaping or yard cleanup

You cannot require tenants to perform repairs that need professional work or that would be unsafe for them to attempt.

Does This Replace the Final Inspection?

No. The pre-move-out inspection does not replace your right to conduct a final inspection after the tenant vacates. You may still find additional issues during the final inspection, and you can deduct for those as long as they’re properly documented and itemized.

What If Tenant Doesn’t Request It?

The pre-move-out inspection is optional for tenants. If they don’t request it, you still must provide the notice informing them of their right. Simply keep a copy of the notice showing you complied with the law. You can proceed directly to the final move-out inspection.

Always keep proof you provided this notice:

  • Certified mail receipt with return receipt requested
  • Hand delivery with tenant’s signed acknowledgment
  • Email delivery (if lease allows electronic notices)
